GIBSON Sues FUNKO Over Unauthorized Use Of Guitar Designs In METALLICA, KISS, GUNS N' ROSES FUNKO POP Figures

Gibson, which has trademarked the shapes of a number of guitars, claims to have contacted Funko in October with an offer of entering into a retroactive licensing agreement, but those discussions were unsuccessful.

Sounds like Gibson needs the $$$ ... but, bobbleheads?

Yeah, but the fakes all weight 11+ lbs and have cheap ceramic pickups.

Trademark infringement is trademark infringement.

Harley Davidson has lawyers scooping up coffee cups at flea markets with their logo on it.

I agree with pinetree. Sounds like Funko blew Gibson off and now they’ll have to pay. I bet they would have been better off making a deal .

Hmmm I cannot see how trade dress comes into play for a general body style--especially after Gibson lost the case against PRS several years ago.

If that Slash doll guitar had four knobs or an open-book headstock...perhaps the case would have merit.

Remember the Guitar Hero thing?

To me that guitar on the right could be any brand.
