As to any "fine" imposed by Menard's, I believe this has become customary in petty theft shoplifting cases wherein the store delivers paperwork to a shoplifting arrestee at the time of arrest that is civil in nature, separate from but in addition to the criminal action being taken. This civil action is for the purpose of recovering costs that the store incurs as a result of the incident (employee wages, etc.).

I think this civil action is taken because
restitution in criminal cases is not always ordered by the court (and if it is, it often goes unpaid). For example, if the court offers a defendant what is called "deferred adjudication" the conviction is set aside if the defendant completes a period of time (like a probation period) without further criminal violations. The arrest record does not go away in cases like this, but it does give a first-time offender an opportunity to keep his record clear of the conviction.

This kind of thing was just beginning back in California about the time I retired in 2005, so I may have some of the details off a bit.

I wouldn't jump to any conclusion yet that the case is any further along than the OP first led us to believe.

Seriously, it's probably an attorney telling to not say another word either in opinion, nor in fact. It's pretty standard to be told to shut up and let them do the talking.

I think that due to the speed.

I have never heard of a petty theft summons being handled in a weeks time. Most often 3 to 6 weeks out, for a first appearance.

For those of you who don't know, when a Cop is on duty he is not your friend, unless you are lost or a young child, age 4.

I sure hope he's OK and that it was a first appearance. My attorney alarms go off like crazy with some of the facts he gave us, but if he should choose not to be represented I don't know if he would be willing to pick apart some of the details on his own.

You may not agree, but is true in realsville.

The job is to get arrests that result in convictions.

Some Cops are decent people willing to give a break, usually these are veterans on the force or Detectives. Others are trying to move up in rank or are just numb from all the crap they have seen and think the worst of anyone they have contact with.

I think this is very true. Too many cops, especially in smaller departments, are not suited to the job. I know this was true in my case and I left. I still carry some of the baggage 40 years later.

I think that depends on circumstances. If you are accused of dhoplifting, definitely. If you aren’t accused of anything, many officers are quite fine to deal with and even helpful.

You can't know that. If he plead guilty it is completely up to the Judge what happens.

With a not guilty plea and a lawyer you at least get an opportunity for a pre trial deal.

The JackAss who cost me my LE job and cost my wife her leg, got 6 months due to a good lawyer. He plead not guilty on the first appearance. Had he plead guilty he could have, and probably would have, gotten 5 years.

Yea, I had a bad taste for defense lawyers at that point.

When I was working in a small local store that sold, among other things, various alcoholic products, I tried to befriend the local cops because we often would both encounter the same riff raff in that small town and felt that a good relationship was beneficial for all. Some took to it, others repelled it. Not sure what they thought I'd be trying to pull.
